At the time of the review, ERO found the service was taking reasonable steps to meet regulatory standards.
Background
The Enchanted Garden is a small privately-owned centre. Children attending the centre range from birth to school age. Approximately quarter of the children who attend are of Māori ethnicity. Since the May 2021 ERO review, the service has made changes to meet all regulatory requirements.
Summary of Review Findings
Children experience a curriculum reflective of the centre play-based philosophy. The environment supports the provision for indoor and outdoor play as well as opportunities for small group interactions. Infants and toddlers experience a calm and slow-paced environment. Teachers engage respectfully with children when carrying out care routines. Assessment and planning documentation reflects the use of Te Whāriki, the early childhood curriculum.
Consistent monitoring and evaluation support the provision of health and safety for children at the service. Governance and management systems for meeting all regulatory standards are well managed.

General Information about Assurance Reviews
All services are licensed under the Education (Early Childhood Services) Regulations 2008. The legal requirements for early childhood services also include the Licensing Criteria for Education and Care Services 2008.
Services must meet the standards in the regulations and the requirements of the licensing criteria to gain and maintain a licence to operate.
ERO undertakes an Akanuku | Assurance Review process in any centre-based service:

having its first ERO review – including if it is part of a governing organisation

previously identified as ‘not well placed’ or ‘requiring further development’
-
that has moved from a provisional to a full licence
-
that have been re-licenced due to a change of ownership
-
where an Akanuku | Assurance Review process is determined to be appropriate.
Management Assurance on Legal Requirements
All early childhood services are required to promote children’s health and safety and to regularly review their compliance with legal requirements. Before the review, the staff and management of a service completed an ERO Centre Assurance Statement and Self-Audit Checklist. In these documents they attested that they have taken all reasonable steps to meet their legal obligations related to:

As part of an Akanuku | Assurance Review ERO assesses whether the regulatory standards are being met. In particular, ERO looks at a service’s systems for managing the following areas that have a potentially high impact on children's wellbeing:

physical safety (including supervision; sleep procedures; accidents; medication; hygiene; excursion policies and procedures)

suitable staffing (including qualification levels; safety checking; teacher certification; ratios)

relevant evacuation procedures and practices.

At the time of the review, ERO identified non-compliance with regulatory standards that must be addressed.
Background
The Enchanted Garden is a privately-owned early childhood centre for children from birth to school age. Around one third of enrolled children are Māori. Since the May 2016 ERO review, the service has had changes in ownership, leadership and staffing. The new owner manages service operations and retains oversight of teaching and learning.
Summary of Review Findings
The service is not meeting two of the licensing criteria within the regulatory standards. While the curriculum provides children with a range of experiences, it is not yet sufficiently responsive to them as competent learners or to their families’ cultures. External support has been sought to establish a suitable policy framework and meet licensing requirements for governance and management. Centre leaders now must ensure policies are consistently implemented as intended.
The design and layout of the premises and facilities support different types of play. Better organisation and monitoring of aspects of the premises and facilities, and health and safety standards, over time, is required.
Actions for Compliance
ERO found areas of non-compliance in the service relating to:
- the quality of teachers’ engagement with children to enhance their learning
- implementation of a responsive curriculum that respects children’s preferences and acknowledges their cultures, languages and identities
- fully completed records of all safety checks and the results for children’s workers.

Since the onsite visit the service has provided ERO with evidence that shows it has addressed the following non-compliances:
- expired category 1 medication and items in the first-aid kit
- obtaining parental permission for children to be given category 1 non-prescription medication
- ensuring indoor furniture is safe and suitable for its intended use
- provision of nappy changing facilities that can be kept hygienically clean
- unsecured items that could fall in the event of an earthquake
- consistent monitoring and recording of children’s sleep times
- opportunities are being provided for parents to contribute to the development and review of the service’s operational documents.
- attendance records that show every child’s attendance at the service.

Recommendation to Ministry of Education
ERO recommends the Ministry follows up with the service provider to ensure that non-compliances identified in this report are addressed promptly.
